Periodic Rules Review – Initial Determinations 

Reason for Proposed Action:

In North Carolina state agencies are required to review their existing rules every 10 years. The first step in this process is making initial determinations as to whether each existing rule is necessary or unnecessary. The Commission has reviewed all existing rules and given each an initial determination of necessary. The public is encouraged to review and comment on these determinations for 60 days. Individual determinations can be found in the linked document below.  Please contact the Office of Conservation Policy & Analysis at regulations@ncwildlife.gov if you have questions. 

Public comment” is defined by G.S. 150B-21.3A(a)(5) as a written objection to all or part of a rule. Additionally, pursuant to G.S. 150B-21.3A(c)(2), in order for the Rules Review Commission to determine whether the public comment has merit, the public comment must address the specific substance of the rule and address any of the standards of Commission review, as set forth in G.S. 150B-21.9(a).
